How do we use input provided and content generate?
Your Content. You may provide input to Penspyre (“Input”), and receive output generated and returned by the Penspyre based on the Input (“Output”). Input and Output are collectively “Content.” You own all Input, and subject to your compliance with these Terms, Penspyre hereby assigns to you all its right, title and interest in and to Output. Penspyre may use Content as necessary to provide and maintain the Services, comply with applicable law, and enforce our policies (see content usage policy). You are responsible for Content, including for ensuring that it does not violate any applicable law.

Use of Content (Inputs and Outputs). Beyond the usage reasons already mentioned, Penspyre does not use your input or output generated (i.e content) to retrain or improve AI models.

Are all generations unique?
Similarity of Content. Due to the nature of machine learning, Output may not be unique across users and Penspyre may generate the same or similar output. For example, you may provide input such as “What color is the sky?” and receive output such as “The sky is blue.” Other users may also ask similar questions and receive the same response. Responses that are requested by and generated for other users are not considered your Content. Penspyre is a tool to provide ideas and help a user get unstuck, not to write an entire work. You are responsible for Content, including for ensuring that it does not violate any applicable law.

What personal information do we process?
When you visit, use, or navigate our Services, we may process personal information depending on how you interact with Penspyre and the Services, the choices you make, and the products and features you use. 

Do we process any sensitive personal information?
We may process sensitive personal information when necessary with your consent or as otherwise permitted by applicable law. 

Do we receive any information from third parties?
We do not receive any information from third parties.

How do we process your information?
We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent. We process your information only when we have a valid legal reason to do so.

1. WHAT INFORMATION DO WE COLLECT?

Penspyre does not collect the content ("input" or "output") generated through use of our platform, beyond checking it to ensure it meets our content & usage policy and to ensure product functionality we do not use it to retrain or improve any AI models. The content is yours and you are responsible for ensuring it meets any applicable laws.

2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent. We process your personal information for a variety of reasons, depending on how you interact with our Services, including: To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order. To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service. To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service. To fulfill and manage your orders. 8. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

9. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information. California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. By using Penspyre you agree to not use Penspyre to spread misinformation or conduct illegal activities. Should a user be found to be utilizing Penspyre for the above purposes Penspyre reserves the right to terminate their account.

How does Penspyre use input provided and content generated?
Your Content. You may provide input to Penspyre (“Input”), and receive output generated and returned by the Penspyre based on the Input (“Output”). Penspyre may use Content as necessary to provide and maintain the Services, comply with applicable law, and enforce our policies. You are responsible for Content, including for ensuring that it does not violate any applicable law.

Penspyre also reserves the right to not generate writing prompts in the below categories.

Hate: content that expresses, incites, or promotes hate based on identity.
Harassment: content that intends to harass, threaten, or bully an individual.
Violence: content that promotes or glorifies violence or celebrates the suffering or humiliation of others.
Self-harm: content that promotes, encourages, or depicts acts of self-harm, such as suicide, cutting, and eating disorders.
Sexual: content meant to arouse sexual excitement, such as the description of sexual activity, or that promotes sexual services (excluding sex education and wellness).
Minors: anything dealing with illegal activities involving minors.
Political: content attempting to influence the political process or to be used for campaigning purposes.
Spam: unsolicited bulk content.
Deception: content that is false or misleading, such as attempting to defraud individuals or spread disinformation.
Malware: content that attempts to generate ransomware, keyloggers, viruses, or other software intended to harm or steal from others


Penspyre uses AI, AI has its own limitations in terms of how it is made, trained and used, see below for further details, by using Penspyre you acknowledge and accept these limitations:

ML (Machine Learning) components have limited robustness:
ML components can only be expected to provide reasonable outputs when given inputs similar to the ones present in the training data. Even if an ML system is considered safe when operated under conditions similar to training data, human operators can provide unfamiliar inputs that put the system into an unsafe state, and it is often not obvious to an operator what inputs will or won’t lead to unsafe behavior. Open-ended ML systems that interact with human operators in the general public are also susceptible to adversarial inputs from malicious operators who deliberately try to put the system into an undesired state. As one mitigation to this, Penspyre users should thus manually evaluate model outputs to ensure it is proper and functional to use, moderation systems are in place to block most unsafe generation but users should judge this as well.

ML (Machine Learning) components are biased:
ML components reflect the values and biases present in the training data, as well as those of their developers. Systems using ML components—especially systems that interact with people in open-ended ways—can perpetuate or amplify those values. Safety concerns arise when the values embedded into ML systems are harmful to individuals, groups of people, or important institutions. For ML components that are trained on massive amounts of value-laden training data collected from public sources, the scale of the training data and complex social factors make it impossible to completely excise harmful values.

Open-ended AI systems have large surface areas for risk:
Systems that have high-bandwidth interactions with end-users, like Penspyre, can be used for virtually any purpose. This makes it impossible to exhaustively enumerate and mitigate all potential safety risks in advance. Thus Penspyre is focused on considering broad categories and contexts of potential harm, continuous detection and response for incidents of harm, and continuous integration of new mitigations as needs become apparent.

Safety is a moving target for ML (Machine Learning) systems:
The safety characteristics of ML systems change every time the ML components are updated, for example if they are retrained with new data, or if new components are trained from scratch with novel architectures. Since ML is an area of active research and new levels of performance are routinely unlocked as research advances, Penspyre will continue to conduct safety analysis and ensure safe usage.
